These Terms and Conditions apply to the use of www.follywild.co.uk and to purchases made through the website.
Please read these terms before placing an order. By submitting an order, you confirm that you have read and accepted these terms.
These terms do not affect your statutory consumer rights.
WHO MAY PLACE AN ORDER
You must be at least 18 years old and legally capable of entering into a contract to place an order through our website.
You are responsible for ensuring that the information supplied when ordering is accurate and complete, including your name, delivery address, email address and personalisation details.
OUR PRODUCTS
Folly & Wild products are handmade in Oxfordshire. Small variations in colour, finish, fragrance appearance, botanical placement and presentation may occur between batches. These natural variations are part of a handmade product and are not normally considered faults.
We make every reasonable effort to ensure product descriptions, measurements, photographs and colours are accurate. However, photographs and screen settings may not reproduce colours or proportions exactly.
Fragrance perception is personal and may vary between individuals. Product descriptions are provided to help explain the general fragrance character and notes but cannot guarantee that every customer will experience a fragrance in exactly the same way.
Nothing in these terms affects your rights if a product is faulty, damaged, unsafe or materially different from its description.
PET-CONSCIOUS HOME FRAGRANCE
Our products are developed with pet-owning homes in mind. The term “pet-conscious” does not mean that a product is guaranteed to be suitable for every animal or every individual circumstance.
Animals can have different sensitivities, health conditions and fragrance preferences. Products must always be used according to their instructions, with appropriate ventilation, and pets should be able to leave the fragranced area.
If your animal has an existing respiratory condition, sensitivity or other health concern, please seek veterinary advice before using fragranced products.
Our product information is not intended to replace veterinary or medical advice.
PRODUCT SAFETY
Customers must read and follow all care instructions, warning labels and safety information supplied with the product.
Candles and wax products must never be left burning unattended and must be kept away from children, animals, draughts and flammable materials.
Folly & Wild cannot be responsible for damage caused by use that is contrary to the safety instructions provided. This does not exclude responsibility where it would be unlawful for us to do so.
PLACING AN ORDER
The website will guide you through the steps required to place an order. Please check your order carefully before submitting payment.
After placing an order, you will normally receive an automated acknowledgement. This confirms that we have received your order but does not necessarily mean that it has been accepted.
A contract is formed when we confirm that the order has been accepted, begin producing a custom or personalised product, or dispatch the order, whichever occurs first.
If we cannot accept an order, we will contact you and refund any payment taken. Reasons may include:
• A product or ingredient being unavailable
• An obvious error in the price or description
• An inability to deliver to the address supplied
• Suspected fraudulent or unauthorised activity
• A legal or carrier restriction affecting the product
We will not cancel an accepted order without a valid reason.
PRICES AND PAYMENT
All prices are displayed in pounds sterling.
Folly & Wild is not currently registered for VAT. VAT is therefore not separately charged or shown on invoices.
Delivery charges are displayed separately during checkout and depend on the selected service, destination, parcel size and weight.
Payment must be authorised at checkout using one of the payment methods offered by the website.
If we discover an obvious pricing error before accepting an order, we will contact you. You may choose to place the order at the correct price or cancel it for a full refund.
BESPOKE AND PERSONALISED ORDERS
Customers are responsible for checking all names, wording, fragrance selections, colours and design details before submitting an order.
Products created to an individual customer’s specifications, including personalised wording, custom designs or custom fragrance blends, cannot normally be cancelled or returned because of a change of mind once production has begun.
This does not affect your statutory rights where a bespoke or personalised item is faulty, damaged, not as described or contains an error made by Folly & Wild.
A standard product does not become non-returnable solely because it was poured or prepared after the order was placed.
PROCESSING AND DELIVERY
Processing and delivery information, including estimated times, local collection and international delivery, is provided in our Delivery and Shipping Policy.
Delivery estimates begin after dispatch and do not include processing, production or setting time.
Royal Mail Tracked 24 and Tracked 48 delivery times are aims and are not guaranteed services.
Folly & Wild remains responsible for an order until it is delivered to the customer or to a safe place, neighbour or recipient specifically nominated by the customer.
If an order is delayed, damaged or lost in transit, please contact us. We will communicate with the delivery provider and resolve the matter in accordance with your statutory rights.
Please read our Delivery and Shipping Policy before ordering.
CANCELLATIONS, RETURNS AND REFUNDS
Cancellation, return and refund eligibility varies depending on whether a product is standard, bespoke or personalised.
Eligible standard products purchased online may normally be cancelled within 14 days of delivery. After notifying us, the customer has a further 14 days to return the goods.
Products made to a customer’s individual specifications or clearly personalised cannot normally be returned because of a change of mind.
Faulty, damaged, incorrect or misdescribed products remain protected by statutory consumer rights.
Please read our Returns, Cancellations and Exchanges Policy for full information and instructions.
OWNERSHIP AND RISK
Ownership of products passes to the customer once full payment has been received.
Responsibility for loss or damage remains with Folly & Wild until the products have been delivered to the customer or to a recipient or location nominated by the customer.
WORKSHOPS, EVENTS AND SERVICES
Workshops, events and other bookable services may be subject to additional booking, cancellation and attendance conditions displayed on the relevant page or provided before booking.
Where specific event or workshop conditions conflict with these general terms, the specific booking conditions will apply.
COMPETITIONS AND PROMOTIONS
Competitions, prize draws, promotional codes and special offers may be governed by additional terms.
Promotional codes:
• Must be used within the stated period
• Cannot normally be exchanged for cash
• Cannot be applied retrospectively
• Cannot be combined unless expressly stated
We reserve the right to withdraw or amend a promotion where there is a genuine error, misuse or circumstance outside our reasonable control. This will not affect orders already accepted unless legally necessary.
CUSTOMER ACCOUNTS
Customers choosing to create an account must provide accurate information and keep their login details secure.
Please contact us promptly if you believe your account has been accessed without permission.
We may restrict or suspend an account where we reasonably believe it is being used fraudulently, unlawfully, abusively or in serious breach of these terms. Where appropriate, we will explain the reason.
ACCEPTABLE WEBSITE USE
You may use our website for lawful personal and shopping purposes.
You must not:
• Attempt to gain unauthorised access to the website or another customer’s account
• Introduce malicious software or interfere with the website’s operation

INTELLECTUAL PROPERTY
The Folly & Wild name, branding, photographs, written content, product designs and other original website materials belong to Folly & Wild or are used with permission.
They may not be copied, reproduced, distributed or used commercially without prior written permission.
THIRD-PARTY LINKS
Our website may contain links to websites operated by third parties.
We are not responsible for the availability, content or privacy practices of third-party websites. Customers should review the policies of any external website they choose to visit.
WEBSITE AVAILABILITY
We aim to keep the website accurate and available but cannot guarantee that it will always operate without interruption or technical error.
We may temporarily suspend access for maintenance, security or circumstances beyond our reasonable control.
Nothing in this section limits our responsibilities relating to an order that has already been accepted.
OUR RESPONSIBILITY TO CUSTOMERS
We are responsible for foreseeable loss or damage caused by our breach of these terms or failure to use reasonable care and skill.
We do not exclude or limit responsibility where doing so would be unlawful, including responsibility for:
• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Faulty or misdescribed goods
• Breach of statutory consumer rights
Our products are supplied for domestic and private use. If a customer uses a product for commercial or business purposes, we are not responsible for business losses such as loss of profit, revenue, opportunity or goodwill, except where the law requires otherwise.
EVENTS OUTSIDE OUR REASONABLE CONTROL
We are not responsible for unavoidable delays caused by events outside our reasonable control, such as severe weather, postal disruption, transport disruption, fire, flood, widespread systems failure or government restrictions.
If such an event affects an accepted order, we will contact you as soon as reasonably possible and take reasonable steps to minimise the delay.
Your statutory rights regarding significantly delayed or undelivered goods remain unaffected.
PRIVACY AND COOKIES
Personal information is handled in accordance with our Privacy Policy.
Our use of cookies is explained in our Cookie Policy. Where consent is legally required for non-essential cookies, customers will be given an appropriate choice.
CHANGES TO THESE TERMS
We may update these terms when our business practices or legal obligations change.
The terms applying to an order will be the version in force when that order is placed. Changes made later will not retrospectively alter an existing order.
The latest revision date will be displayed at the top of this page.
GOVERNING LAW
These terms are governed by the laws of England and Wales.
If you live elsewhere in the United Kingdom, you retain any mandatory consumer protections available to you and may be entitled to bring proceedings in the courts where you live.
Nothing in these terms removes any rights you have under applicable consumer law.
SEVERABILITY
If any part of these terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply.
